Tenacity Locks Ltd director sues man who conned him Sh 3M

The director of Tenacity Locks Limited has sued a man who allegedly obtained millions of shillings from him by false pretenses.

Kennedy Wachira Ndwiga accuses Peter Nzioki Mutiso of obtaining Sh 3,135,400 by pretending that he was employed by Top Marine Shipping Limited as a clearing agent and was in position to do clearing on imported goods from Guangzhou China to Kenya.

Mutiso who resides in Mombasa is alleged to have committed the offence between 25th June and 13th September 2018 in Nairobi jointly with others not before court.

He denied the charges before Principal Magistrate Kenneth Cheruiyot.

The prosecution informed the court that the matter is related to another that is already before court and pray that both be mentioned on the same day in order for the state to make an application for consolidation.

Through his lawyer, Mutiso pleaded with the court to release him on a cash bail of a Sh 100,000 on grounds that he has a family that solely depends on him adding that his accounts have been frozen.

Magistrate Cheruiyot ruled that he considered the submissions by the defense and released him on a bond of Sh 500,000 or alternative cash bail of Sh 100,000. Upon payment of the cash bail the accused person was ordered to provide one person as surety.

The matter will be mentioned on 14th January 2019.
