Court grants Marianne Kitany access to disputed Runda home, Senator Linturi barred

Court has granted Marianne Kitany access to the Runda home and barred her husband Senator Mithika Linturi from accessing the premises.

However, the orders are only in force until a divorce matter filed at the high court is determined.

The order, though, does not  affect their children.

Kitany moved to court seeking orders prohibiting Linturi from evicting and abusing her.

Magistrate Isaac Orenge ruled that the application by Kitany is merited.

“I find that the applicant has made out a case to warrant the issuance of the orders sought,” ruled Honorable Orenge.

Linturi’s lawyer requested for a stay of the orders pending appeal of the ruling.

However, Kitany’s lawyer Dunstan Omari objected saying that the respondents should file a formal application of stay.

The court heard that the two married under customary law.
