Pastor Ezekiel’s lawyers frustrated as Tribunal fails to hear appeal on suspended broadcast licence

The Communications and Multimedia Appeals Tribunal has adjourned the appeal by controversial televangelist Ezekiel Odero for lack of quorum.

The pastor’s lawyers led by lawyer Danstan Omari lamented saying that the lack of quorum was either by design or by default.

Lawyer Shadrack Wambui told journalists outside Milimani Law Courts that one of the members of the tribunal had communicated that he would not preside over the affairs of the tribunal.

While expressing their disappointment, the lawyers said that the Chair of the tribunal told them to be patient as they wait for the Ministry of ICT to appoint another member to replace honourable Collins Wanderi.

However, it was not specified how long it would take the ministry to appoint another member to the tribunal.

For the aforementioned reason, the lawyers plan to move to the High Court to raise their grievances.

“For those reasons, and knowing too well that we have a duty to have some of these issues determined expeditiously, we are going to approach the High Court yet again and seek an exemption in law since there is nothing the tribunal can do,” Lawyer Shadrack Wambui said.

According to Omari, the State has failed or instructed the ministry of ICT not to form the quorum today when the matter was scheduled for hearing. 

“That does not stop us from moving further because this is a course of clear manifestation of the persecution of Christianity. We shall be moving to court tomorrow to bring to the attention of the High Court the happenings in the tribunal and seek for recourse for the five million followers of pastor Ezekiel,” Omari claimed.

The Communications Authority of Kenya (CAK) Director General Ezra Chiloba suspended Pastor Ezekiel’s World Televangelism TV and controversial Pastor Paul Mackenzie’s Times TV.

The two stations are alleged to have aired inappropriate content on exorcism during the watershed period and over a dozen other violations.

The two televangelists are under probe following the Shakahola tragedy that has so far claimed the lives of over 230 people.

Some of the people who died at Pastor Ezekiel’s church are alleged to have died under mysterious circumstances and buried in a piece of land in Shakahola associated with Mackenzie.
