A 47 year old man has been arraigned in court and charged with incest contrary to section 20(1) of the sexual offences.
George Othiambo Oyoo is charged with defiling his ten year old daughter between March and May 31st 2017 at their home in riverside estate in Ruaraka within Nairobi County.
The accused who is a father of three children among them the victim, pleaded not guilty to the charges before Milimani Senior Principal Magistrate Kennedy Cheruiyot.
The accused told the court to release him on affordable cash bail since he is a single parent to the three children since his two wives had passed on.
The prosecution objected to his release on bond on grounds that the victim is his daughter and therefore there is likelihood of interfering with witnesses.
It is alleged that the incident was confirmed by the class teacher who saw the child’s uniform with blood at the back area.
The teacher asked the girl why she was bleeding but she did not open up until May 30th 2017 when the teacher told the father to buy sanitary towels for daughter but he insisted that the child was of tender age and had not yet received her periods.
This prompted the teacher to inquire from the child what was happening and she explained that the father had been continuously defiling her since March after her sister left for the rural home and left her alone with the father.
The class teacher informed her workmate who proceeded with the child and reported the matter at Ruaraka Police station where the child said the father has been defiling her at night by removing her inner wear and threatening her not report to anyone.
It is alleged that the class teacher and church members had noticed that the girl’s behavior had changed.She was always sad and silent which was unusual to them since they knew her well.
She was then taken to the hospital where it was confirmed having been defiled. The father was then arrested.
After investigations it was confirmed that the girl had reported the incident to her uncle who did nothing to help her. This prompted her to report the matter to the class teacher.
The magistrate did not grand him bond and ordered that he be remanded until the victim testifies in court.
The case will be heard on July 12th 2017.
