Man charged with forging the will of late businessman Balkrishna Ramji Devani

A man has been charged with intermeddling with the property of the late businessman Balkrishna Ramji Haribhai Devani.

Samuel Ngungi Ndinguri is accused intermeddling by transferring the shares of Pelikan Signs Limited without express authority.

Ndinguri who allegedly worked for the deceased as a director is alleged to have committed the offense on 11th November 2019 at the offices of the Registrar of Companies, Sheria House in Nairobi County while not being the administrator to Devani’s estate.

The accused is also charged with conspiracy to defeat the course of justice by filing a supporting affidavit in Nairobi High Court Succession Cause Number E623 of 2020, namely in the Matter of the Estate of Balkrishna Ramji Haribhai Devani (Deceased) using falsified documents, to wit codicil to the will of Devani dated 5th June 2019.

In addition, Ndinguri is accused of conspiring with others not before court to forge Devani’s will on 5th June 2019.

It is also alleged that the accused jointly with others not before court, forged minutes pf the meeting of the board of directors of Pelican Signs Limited purporting them to be genuine.

He is said to to have committed the offense on 11th November 2019 at Pelican Signs Limited offices in Nairobi, with intent to defraud.

Ndinguri denied the charges before Chief Magistrate Susan Shitubi.

His co-accused persons, Dinta Devani Pathania, Abhay Singh Pathania, and Addah Nduta Ndambuki did not appear in court to answer to the charges.

A warrant of arrest against them was issued after the prosecution told the court that they had all been informed by the investigating officer to appear in court on 23rd April 2024 for plea taking.

Ndinguri was granted a bond of Sh 3 million plus one surety of a similar amount.

Alternatively, he can pay a cash bail of Sh 1 million and provide two contact persons to secure his release pending the hearing and determination of the case.

The matter will be mentioned on 6th May 2024 for pre-trial directions.
