Destiny freight Services Director in court over Sh 1.2M evaded tax

The Director of Destiny freight Services Limited has been charged with fraudulent evasion of payment of duty contrary to section 203(e)of the East African Community custom management  ACT,2004.

Mwamachi Mzee was charged with fraudulently evading the payment of duty amounting to Sh 1,289,780 by failing to declare the correct tax regime for goods imported under custom import entry No.2018 ICD 20821.

Mzee is alleged to have committed the offence on or about 13th April 2018 at Embakasi Inland Container Deport (ICD) in Nairobi jointly with others not before court.

The accused faced another charge of making a false declaration in the custom import entry No.2018 ICD 20821 by declaring the tax regime as C490 which is a tax regime for duty exempt goods for a returning resident as opposed to C400 which is tax regime for duty paid imports for home use thereby failing to pay import duty of the above amount.

The Director denied the charges before Principal magistrate Peter Ooko and was released on a bond of Sh 300,000 or alternative cash bail of Sh 100,000. The case will be mentioned on 13th June 2018.
